Information We Collect and How We Use It
Personal Information
You are not required to provide any personal information to browse or access the public area of the Site. However, to access or use certain services at the Site, you are required to provide personal information. “Personal information” is information that is unique to you, and includes, but is not limited to, your email address and name (and any formerly used names), and legal practice experience.
Personal information is collected on the Site when you subscribe to updates, post comments on the blog, or when you contact us.
NCBE uses your personal information for the purposes described where it is collected. Generally, NCBE uses your personal information for identification purposes; NCBE does not use personal information for marketing or promotional purposes. If you are located outside the United States, please note that we process and store personal information in the United States.

By clicking “Submit” to receive email updates, you agree that the NextGen Bar Exam email service is exclusively for providing updates about activities of the NextGen Bar Exam and NCBE may share your contact information with MailChimp (https://mailchimp.com/legal/privacy/#contacts) only pursuant to their limited role as a data processor. Your contact information will not be used or shared for any other purpose.
Blog
By posting a comment, you agree that you are responsible for the content of your comment, and grant to NCBE a nonexclusive, irrevocable, worldwide license to display, modify, store, and use the information for the limited purposes of the NextGen Bar Exam. Further, you grant the NextGen Bar Exam the right to associate your name, image, and biographical data in connection with your submitted content. You also agree that you are not using a misleading name or email address, nor soliciting for commercial or political purposes. Your comment will be posted subject to review by a moderator. Moderating and posting of comments will typically occur during normal business hours.
Contact Form
We use the Contact Form 7 plugin to manage contact form submissions. Messages that you send to us by email, including by use of the Contact Us form on the Site, may not be secure, and use of email is not recommended for sending confidential or sensitive information to us. We store user input data sent through the contact forms on this website, along with meta information about the submissions, including the time stamp, the origin IP address, and the user agent (browser). The information is also stored in the database on our web servers for backup and later reference purposes.
Cookies and Tracking Technologies
Cookies are used by NCBE to keep track of your site activity. Information transferred through cookies does not contain any personally identifying information, nor is it shared with any other parties. We use persistent and non-persistent cookies to make it easier for you to navigate the Site. If you reject cookies, you may still use the Site but your ability to use some areas of the Site will be limited.
NCBE’s web servers use software and plugins (Wordfence) to monitor traffic by automatically recording every visitor’s host, domain name, pages visited, length of user sessions, browser type, and/or IP address. We use Google Analytics to track interaction with specific features of our website. We do not (and do not allow any third party to) use this service to track, collect, or upload any data that personally identifies an individual, or other data which can be reasonably linked to such information by Google. For information on how Google Analytics collects and processes data, please review “How Google uses data when you use our partners’ sites or apps” located at www.google.com/policies/privacy/partners/.
Really Simple SSL
Really Simple SSL and Really Simple SSL add-ons do not process any personal identifiable information, so the GDPR does not apply to these plugins or usage of these plugins on your website. You can find our privacy policy here.

Google Web Fonts
For uniform representation of fonts, this page uses web fonts provided by Google. When you open a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.
For this purpose your browser has to establish a direct connection to Google servers. Google thus becomes aware that our web page was accessed via your IP address. The use of Google Web fonts is done in the interest of a uniform and attractive presentation of our plugin. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO.
If your browser does not support web fonts, a standard font is used by your computer.
Further information about handling user data, can be found at https://developers.google.com/fonts/faq and in Google’s privacy policy at https://www.google.com/policies/privacy/.
SoundCloud
On our pages, plugins of the SoundCloud social network (SoundCloud Limited, Berners House, 47-48 Berners Street, London W1T 3NF, UK) may be integrated. The SoundCloud plugins can be recognized by the SoundCloud logo on our site.
When you visit our site, a direct connection between your browser and the SoundCloud server is established via the plugin. This enables SoundCloud to receive information that you have visited our site from your IP address. If you click on the “Like” or “Share” buttons while you are logged into your SoundCloud account, you can link the content of our pages to your SoundCloud profile. This means that SoundCloud can associate visits to our pages with your user account. We would like to point out that, as the provider of these pages, we have no knowledge of the content of the data transmitted or how it will be used by SoundCloud. For more information on SoundCloud’s privacy policy, please go to https://soundcloud.com/pages/privacy.
If you do not want SoundCloud to associate your visit to our site with your SoundCloud account, please log out of your SoundCloud account.

NCBE has physical, technical, and administrative safeguards in place to protect your personal information. We use industry-standard Transport Layer Security technology (TLS) to encrypt data transmissions. To learn more about TLS, view http://www.webopedia.com/TERM/T/TLS.html. Despite our security measures, no data transmission over the Internet or electronic storage is 100% secure. As a result, we cannot and do not warrant the security of your personal information.
Disclosure of Personal Information to Third Parties
NCBE reserves the right to use or disclose your personal information when NCBE reasonably believes it is needed to (i) respond to information requests by law enforcement or other governmental authorities; (ii) comply with any law, regulation, subpoena or other legal process, or court order; (iii) investigate and help prevent security threats, fraud, malicious activity, or inappropriate, unauthorized, or illegal activity involving our examinations, services, or networks; or (iv) enforce or protect our rights and property, including intellectual property. In these four circumstances, NCBE may disclose your personal information without notice to such third parties as we deem reasonably necessary.
Data Retention
NCBE will retain your personal information only for as long as we deem appropriate and necessary, or as permitted by law.
Links
For your convenience, we may provide links to other websites and web pages that we do not control. NCBE does not endorse and is not responsible for the privacy practices or the content of any such linked websites. If you submit information to any of those sites, your information is governed by their privacy policies. Use of any linked websites is at the user’s own risk.
Children’s Privacy
This website is not designed to attract children. Accordingly, we do not knowingly collect personal information from anyone under 13 years of age.

If we change our policies, the changes will be posted to this privacy policy on the Site. At our discretion, we may also provide notice in the NCBE Accounts and on other pages of the Site as we deem appropriate.
