Prior to the prototype exam, please review the participant agreement below, which you consented to when you signed up for the prototype exam.
The NextGen prototype exam content is owned by NCBE and is protected by US copyright laws. Conduct undermining the integrity and fairness of the prototype exam administration process is prohibited before, during, and after the examination. If you are dismissed from testing for any reason, you will not be eligible to participate in future prototype exam sessions.
The prototype exam is a research study that will play a crucial role in launching the next generation of the bar exam. For the data NCBE collects to be meaningful, your participation in the prototype exam should simulate a real bar exam as much as possible.
NCBE and its service providers will use your personal information collected during the prototype exam (e.g., name, NCBE Number, email address, law school) in accordance with the NCBE privacy policy (https://www.ncbex.org/privacy-policy/) and may share anonymized, aggregated data that does not identify you individually with researchers and/or your law school for exam development and improvement purposes.
I understand that conduct undermining the integrity and fairness of the prototype exam process is prohibited before, during, and after the examination, including but not limited to the following conduct:
- Falsification of my identity/credentials or impersonation of another participant
- Taking test content out of the testing room by any means
- Disclosing the substance or details of any test question, including the question’s fact pattern, option choices, or answer, in whole or in part, to anyone via electronic (including email, blogs, and online social and professional networking sites), telephonic, written, oral, or any other means
- Reproducing, paraphrasing, summarizing, or describing to any other person any test content from memory
- Distributing, forwarding, re-posting, hosting, or otherwise publicizing, on the internet or via other means, exam content that others have disclosed
- Copying answers from another participant or sharing answers with another participant
- Bringing and accessing unauthorized or prohibited items in the testing room
- Accessing stored personal items or leaving the building during the test
- Causing a disruption or disturbance (for example, eating, drinking, chewing gum, and/or making noise or moving disruptively)
- Threatening anyone involved in the administration of the prototype exam, or any other participant
I understand that engaging in prohibited conduct before, during, or after the prototype exam could result in some or all of the following penalties:
- Denial of my bar application on character and fitness grounds
- Disciplinary action by a bar authority if I am already admitted to practice law
- Criminal penalties
- Forfeiture of my prototype exam compensation
- Civil liability
- Immediate dismissal from the prototype exam
- Denial of my request to sign up for this and/or future prototype exams
- Withholding of my prototype exam performance feedback
I understand that my identification (ID) must be government issued and include my first and last name, a recent recognizable photo, and a signature. If I do not have a qualifying ID issued in the US, my ID must be an international travel passport issued by my country of citizenship. To be acceptable, passports must be printed in roman characters.
Common forms of ID include the following (expired forms of ID are not acceptable unless accompanied by valid renewal papers):
- US passport or passport card
- US driver’s license or similar state identification card
- US military ID (including spouse and dependents)
- US alien registration card (permanent resident or green card, visa)
- International travel passport
If my government-issued ID is missing a visible signature, I will also need to bring a secondary ID containing:
- first and last name and signature OR
- first and last name and recent recognizable photo
Common forms of secondary ID include:
- School/university/college ID
- Credit card
- Library card
I understand that if I do not present acceptable ID(s), I may be prohibited from participating in the prototype exam.
I understand that except for my laptop, laptop power cord, and ID, no personal items can be brought into the testing room; water is also permitted if it is in a clear bottle with no labels. I also understand that refusing to store personal items or bringing unauthorized/prohibited items into the testing room may result in immediate dismissal and/or cancellation of future prototype exam participation, among other penalties.
Prohibited items include but are not limited to:
- cell or mobile phones
- hand-held computers/personal digital assistants (PDAs), media players, e-cigarettes, or other electronic devices
- cameras or any picture-taking devices
- smart watches, fitness trackers, or other wearable technology
- watches or timers of any kind
- headphones or earbuds
- larger jewelry or hair accessories
- wallets, purses, bags, eyeglass cases
- hats (and other nonreligious head coverings), coats, jackets
- books, notes, scratch paper, or paper of any kind
- pens or pencils of any kind
- firearms or other weapons
- food or beverages (other than water in a clear bottle with no labels)
I agree to follow check-in procedures and understand that I may be asked to do the following:
- empty my pockets
- remove jewelry and hair accessories
- show my ears
- roll up my sleeves
- pat myself down (for example: arms, legs, waistline)
I understand that NCBE takes steps to ensure standardized and secure administration of the prototype exam. NCBE will make every effort to provide feedback on my prototype exam performance. However, NCBE reserves the right to withhold performance feedback when there is reason to believe that the performance indicators are invalid, such as those that
- cause the prototype exam administration to be canceled or interrupted;
- involve a mistiming of the test;
- result in a deviation from required testing procedures;
- indicate possible advance access to prototype exam content;
- demonstrate unusual similarities in answers among participants; or
- otherwise disrupt or compromise the normal testing process or the validity of the performance indicators.
- I hereby authorize NCBE to collect, use, and retain my personal information for research purposes.
- I acknowledge that the prototype exam is a study being conducted by NCBE to gather data from law school graduates regarding bar exam test questions for potential use on a future bar exam.
- I certify that in clicking the “Submit Sign-Up” button, I have confirmed my name, email, NCBE Number, date of birth, law school, law school start year, and the date my JD or first degree in law was awarded or is expected. I further certify that this personal information is mine and that I am not falsifying my identity.
- I certify that I took a bar exam in July 2024, February 2024, or July 2023 that included the Multistate Bar Exam (MBE).
- I certify that I am not a law school faculty member (including adjunct faculty and lecturers); law school staff; or affiliated in any way with any bar prep company, including as an employee, volunteer, or grader.
- I certify that I will not disclose, transmit, copy, or otherwise reproduce any prototype exam questions or answers, in whole or in part, during or after the test, whether orally, in writing, electronically, or otherwise.
- I certify that I have read this Participant Agreement and agree to comply with and be bound by its policies and procedures.
- I acknowledge that my participation in the prototype exam is separate from any bar exam and does not affect my eligibility to take a bar exam, obtain bar exam scores, or be admitted to the bar in any jurisdiction.
- I acknowledge that any misconduct in connection with the prototype exam may be reported to NCBE and/or my jurisdiction.
